Jogen Terms of Service

Please read these Terms, the Privacy Policy, and the AI Data Processing Statement before using Jogen. By accepting these Terms, you may access features that require an account. If you disagree, stop using the service.

1. Scope of service

Jogen offers AI character conversations and scenarios across 12 languages, text and voice aids, learning history, and points. Available features, languages, characters, point costs, and supported devices are shown in the app. We may adjust features for maintenance, security, legal, or third party service reasons and will reasonably notify users of material changes to paid benefits.

2. Accounts and sign-in

The current sign-in options are Google and, on iOS, Apple. Use an account you are entitled to use, protect your device and credentials, and report unauthorized access. Guest access is limited and guest data may remain only on that device.

3. Minors

Users under 18 should obtain a parent or guardian's review and consent before using the service and its related data processing. Additional consent required by local law must be obtained first. We may restrict access where legally necessary.

4. Points, prices, and payment

Jogen currently sells one-time point packs and has no auto-renewing subscription. Products, point amounts, local prices, taxes, and point charges are displayed during purchase and use. Points can be used only for designated functions in this app; they cannot be transferred or redeemed for cash. Apple App Store or Google Play processes purchases. Points are credited to the associated account only after store transaction verification. Check that you are signed in to the intended account before buying.

5. Digital services and refunds

Points unlock digital AI services. Request refunds, cancellations, or charge dispute handling through the store where you bought them. We adjust points according to applicable law and verified store outcomes. A purchase, account deletion, or stopping use does not itself trigger a refund. These Terms do not remove statutory refund or withdrawal rights. Any exception for digital content depends on applicable local law, required disclosures, and the facts of the transaction.

6. Acceptable use

Do not impersonate others, infringe rights, submit unlawful content, harass, distribute malware, disrupt the service, bypass points or authentication, scrape content at scale, or use prompt injection to evade AI safeguards. Do not reverse engineer or commercially reuse the app, characters, images, voices, or protected content without authorization. We may take necessary and proportionate action against violations.

7. Your content

You keep the rights you already hold in your messages, study notes, and other submissions and must have permission to provide them. You allow us and necessary processors to handle, transmit, and store that content to provide conversation, speech, synchronization, storage, and security. Ownership does not transfer. This permission does not authorize public marketing of private conversations. Actual third party AI processing is described in the AI Data Processing Statement and applicable provider terms.

8. Intellectual property

Jogen's code, interface, character designs, artwork, text, audio, trademarks, and other content belong to WayneMVRS or their rightful owners. Except as allowed by law or prior permission, you may not reproduce, distribute, adapt, or commercially exploit them. AI or device-generated voice content may also be subject to provider terms.

9. Third party services

Sign-in, storage, AI models, speech, and payments may rely on Google, Apple, Supabase, OpenAI, and other providers. Their availability, data handling, billing, and refunds are subject to their policies and technical conditions. We will reasonably assist in investigating outages.

10. Availability and maintenance

We make reasonable efforts to maintain the service but do not guarantee uninterrupted, error-free operation or fitness for every device or purpose. Maintenance and network, store, cloud, or AI outages may temporarily affect access. We will reasonably work to restore service and resolve affected transactions.

11. Learning and AI content

AI characters and replies are for language practice. They are not people or professional advisers. Translation, pronunciation, grammar, and factual content may be wrong. Verify important information yourself. AI replies are not medical, legal, financial, or other professional advice. Review the displayed data processing and consent options before using voice features.

12. Liability

We remain responsible for liabilities that cannot legally be excluded or limited. Otherwise, our responsibility for attributable harm is determined under applicable law and the specific facts, including any intentional misconduct or gross negligence. These Terms do not restrict statutory consumer rights.

13. Personal data

We process necessary data for accounts, practice, chat, voice, transaction verification, safety, and support. Data categories, recipients, retention, cross-border processing, and your rights are explained in the Privacy Policy and AI Data Processing Statement.

14. Notices and contact

We may provide notices through the app, website, store listing, or available account contact method. Contact support at waynemvrs@gmail.com. Material matters affecting your rights will be notified reasonably.

15. Restrictions and termination

We may restrict, suspend, or close access for unlawful activity, infringement, fraud, malicious automation, payment evasion, security abuse, or legal requirements. Except in urgent safety or legal cases, we will reasonably provide an explanation or an appeal route. Unused points and paid amounts are handled under applicable law, store refund rules, and the circumstances.

16. Account deletion

You can request deletion of Jogen account data in app settings or through the website's account-deletion page. This removes Jogen conversations, learning history, and unused points; necessary transaction audit records may be retained after unlinking them from the account. Shared sign-in identity and data from other WayneMVRS apps are outside a Jogen-only deletion. Deletion does not automatically refund purchases.

17. Changes

We show the last update date on this page and will reasonably notify you in advance of material changes. If you disagree with revised Terms, you can stop using Jogen and request account deletion. Changes do not retroactively remove statutory rights.

18. Law and disputes

Subject to mandatory consumer protections where you live, these Terms are interpreted under the laws of Taiwan. Please contact us first to seek a resolution. If litigation is necessary, statutory jurisdiction rules apply; these Terms do not exclude a consumer's mandatory venue rights.

19. Severability

If a provision is invalid, the remaining provisions remain effective to the extent the law allows. Headings are for convenience. Applicable law and related policies govern matters not addressed here.

歡迎使用 WayneMVRS（以下稱「本公司」、「我們」）所提供之「如言 Jogen」應用程式、網站、相關內容、功能、點數商品及服務（以下合稱「本服務」）。當您註冊、登入、下載、瀏覽、使用本服務，或購買點數商品時，即表示您已閱讀、瞭解並同意受本條款拘束。

如您不同意本條款之全部或一部，請勿註冊、登入、使用本服務。

第 1 條　適用範圍與服務內容

1. 本服務係由 WayneMVRS 提供之多語言學習相關數位服務，內容包括但不限於： （一）AI 角色文字對話、情境練習、翻譯、發音提示與語音。 （二）對話歷程、學習筆記、語言偏好及其他學習輔助功能。 （三）AI 語言會話學伴（AI Partner）與即時語音練習。 （四）免費功能、一次性點數商品及其他未來新增功能。

2. 本服務之實際內容、功能、點數商品、價格、扣點規則、使用限制及適用裝置，均以本服務當時頁面顯示、購買流程、方案說明及公告內容為準。

3. 我們得基於營運、技術、安全、法令遵循、第三方服務調整或其他合理原因，新增、變更、限制、暫停或終止本服務之全部或一部。

4. 前項調整如涉及已付費使用者之重大權益，我們將於合理期間內，以 App 內公告、網站公告、推播通知或其他適當方式通知。

第 2 條　帳號註冊、登入方式與使用資格

1. 本服務目前僅提供以下第三方帳號登入方式： （一）Google 帳號登入 （二）iOS 上的 Apple 帳號登入

2. 本服務目前不提供電子郵件密碼註冊或登入機制。您應確保所使用之 Google 帳號或 Apple 帳號為您本人合法持有並有權使用之帳號。

3. 您應提供真實、正確且完整之必要資料，並於資料有變更時自行維持其正確性。若因您提供之資料不實、不完整或過期，致影響服務使用、權益通知、付款驗證、帳號識別或爭議處理者，相關風險由您自行承擔。

4. 您不得冒用他人身分、使用未經授權之第三方帳號，或以任何方式規避本服務之資格限制、地區限制、點數限制或安全驗證機制。

5. 您應自行妥善保管所使用之第三方登入帳號及其裝置安全。因 Google 帳號、Apple 帳號遭盜用、未授權存取、裝置遺失、系統設定錯誤或其他可歸責於您之事由所生之損害或風險，原則上由您自行負責。

6. 若您發現帳號有遭未授權使用、異常登入或任何安全疑慮，應立即停止使用並儘速通知我們。

第 3 條　未成年人使用

1. 如您未滿 18 歲，應於您的法定代理人或監護人閱讀、瞭解並同意本條款後，始得註冊、登入、購買或使用本服務。

2. 如您未滿法定成年年齡而使用本服務，視為您的法定代理人或監護人已同意您使用本服務及接受本條款之拘束。

3. 我們得於合理範圍內要求您或您的法定代理人提出必要之同意或身分驗證資料。若無法證明已取得合法同意，我們得拒絕提供服務、限制功能、暫停或終止帳號。

第 4 條　一次性點數、付款與價格

1. 本服務部分 AI 對話及語音功能使用點數。現有商品為一次性購買，並非自動續訂；商品內容、點數、價格、稅費及扣點規則，以實際購買及使用頁面顯示為準。

2. 若您透過 Apple App Store 或 Google Play 完成付款、退款、帳單管理或發票處理，應依該平台之規則、程序及技術限制辦理。我們不直接保管您的完整信用卡資料。

3. 付款完成後，本服務須核驗平台交易，才會將點數記入購買時登入的如言帳號；處理可能因商店或網路狀況延遲。如點數未到帳，請提供必要交易資訊聯絡我們。

4. 點數僅供本服務指定功能使用，不得轉售、移轉、兌換現金，亦非存款或法定貨幣。每項功能消耗的點數以使用前 App 顯示為準。

5. 各商品價格、促銷條件與可取得點數，均以實際購買當時頁面顯示為準。對未來購買價格或商品內容之調整，不溯及已完成之交易。

6. 如發生重複扣款、未經授權扣款、系統誤扣或其他帳務異常，請儘速通知我們；平台處理的交易可循原平台退款或申訴機制處理，我們會於合理範圍內協助。

第 5 條　數位內容、七日解除權例外與退費政策

1. 本服務之點數用於取得 AI 對話、語音及其他數位功能，性質上可能屬非以有形媒介提供之數位內容或線上服務。

2. 您於購買、開通、啟用或開始使用前述數位內容或線上服務前，應確認購買頁所列內容、價格及提供方式。

3. 如符合法令所定合理例外情形，且已依法完成必要告知並取得同意，已開始提供之數位內容或線上服務可能不適用七日無條件解除權；是否適用仍依交易所在地法律及個案事實認定。

4. 如您的付款係透過 Apple App Store 或 Google Play 完成，退款、撤銷交易、爭議款處理及帳單更正等事項，應優先依該平台之規定辦理。

5. 如法令另有強制規定，或個案事實顯示您依法得主張退款者，我們仍將依適用法令處理，不以前述條款排除您的法定權利。退款或交易撤銷後，點數餘額可能按平台核銷結果調整。

第 6 條　使用規則與禁止行為

您同意不得從事下列行為：

1. 違反中華民國法令、所在地法令、公序良俗或本條款之行為。

2. 冒用他人身分、偽造資料、未經授權使用他人 Google 帳號或 Apple 帳號登入本服務。

3. 以出售、轉租、分租、轉讓、共享帳號、代為登入、規避扣點或其他方式，將本服務供第三人商業使用或非個人正常學習使用。

4. 擅自重製、下載、錄音、錄影、截圖彙編、散布、公開傳輸、改作、出版、販售、再授權或以其他方式利用本服務內容。

5. 對本服務、App、網站、程式碼、API、演算法、資料庫、內容架構或系統機制進行逆向工程、反編譯、反組譯、破解、繞過授權或測試弱點。

6. 使用爬蟲、機器人、自動化腳本、外掛、模擬器、批次請求工具或其他技術，大量抓取、複製、監測、干擾或存取本服務資料。

7. 散布病毒、惡意程式、垃圾訊息、廣告、詐欺內容、侵權內容、誹謗內容、猥褻內容、仇恨內容或其他不當資訊。

8. 干擾或破壞本服務正常運作、伺服器、網路、流量分配、驗證機制或安全措施。

9. 利用本服務從事洗稿、內容農場、自動生成濫用、商業競業分析、模型訓練資料蒐集或其他超出正常個人學習目的之用途。

10. 於 AI 會話、對話練習或互動功能中，透過提示詞注入（Prompt Injection）、誘導指令或其他技術手段，意圖繞過安全防護機制，或促使 AI 輸出違法、侵權、騷擾、仇恨、暴力或其他不當內容。

11. 其他經我們合理判斷足以損害本公司、其他使用者、合作夥伴或第三人權益之行為。

第 7 條　使用者內容與授權

1. 本服務如提供對話輸入、學習筆記、語音逐字稿、回饋及學習紀錄或其他由您提供之內容，該等內容以下統稱「使用者內容」。

2. 您對於使用者內容，於原權利範圍內仍保有其權利；但您保證您有權提供該等內容，且不侵害任何第三人之智慧財產權、隱私權、肖像權、營業秘密或其他權利。

3. 為提供、維護、改善、備份、傳輸及保護本服務之必要範圍內，您同意我們及受託處理者得以非專屬方式儲存、重製、格式轉換、傳輸及處理使用者內容；私人對話不因此授權公開展示或用於宣傳。

4. 前項授權僅限於提供本服務及相關營運必要範圍，不因此移轉您原有之所有權。

5. 如您刪除使用者內容或刪除帳號，我們將依系統機制、備份週期、法令保存義務及隱私權政策處理；已為匿名化或依法得保留之資料，不在此限。

第 8 條　智慧財產權

1. 本服務之軟體、介面、設計、版面、資料結構、角色設定、文字、圖片、音訊、語音、商標、標識、程式碼及其他一切內容，其智慧財產權及相關權利均屬 WayneMVRS 或合法權利人所有。

2. 除法律明文允許或經我們事前書面同意外，您不得擅自使用、重製、散布、公開傳輸、改作、翻譯、出租、出借、販售、授權、再授權或以其他方式利用前述內容。

3. 本服務部分語音內容透過第三方語音技術生成；相關內容之使用仍可能受提供者之授權條件、技術限制或權利規範拘束。

4. 您同意不移除、遮蔽或變更本服務上之任何著作權、商標、專利、授權聲明或其他權利標示。

第 9 條　第三方平台與第三方服務

1. 本服務可能整合或連結 Google、Apple、應用程式商店、分析工具、雲端儲存、付款機制、推播服務或其他第三方服務。

2. 第三方服務之可用性、功能、穩定性、登入、付款、退款、帳單、資料同步、權限管理及隱私處理，可能受第三方服務提供者之條款、政策及技術限制影響。

3. 對於非可歸責於我們之第三方服務中斷、錯誤、延遲、資料不同步、登入失敗、扣款失敗或退款處理爭議，我們將盡合理協助，但不保證得完全排除或即時解決。

第 10 條　服務可用性、維護與中斷

1. 我們將依當時技術及合理商業努力維持本服務之可用性與安全性，但不保證本服務永不中斷、毫無錯誤、完全無病毒、完全相容於所有裝置或永遠符合您之特定需求。

2. 本服務可能因下列原因而全部或部分中斷、延遲、異常、資料暫失或功能受限： （一）例行維護、更新、搬遷、升級、測試。 （二）第三方平台、第三方服務、電信網路、雲端基礎設施或支付系統異常。 （三）天災、停電、火災、水災、地震、戰爭、罷工、政府命令、資安事件或其他不可抗力事由。 （四）其他非可歸責於我們之事由。

3. 如發生前項情形，我們將於合理可行範圍內儘速修復並視情況公告或通知。

4. 對於非可歸責於我們之中斷、遲延或資料損失，我們不負損害賠償責任；但法律另有強制規定，或因我們故意或重大過失所致者，不在此限。

第 11 條　學習成效與 AI 內容聲明

1. 本服務係提供語言學習之工具與輔助功能，不構成對口說能力、語言檢定、考試分數、求職成果或其他學習成果之保證。

2. 學習成果將因個人程度、練習頻率、投入時間、理解能力、語言環境及其他個人因素而異。

3. 本服務之語言提示、翻譯、發音與練習建議僅供參考，不構成任何保證或專業承諾。

4. AI 角色對話、情境練習及語言提示由模型自動生成，不保證文法、翻譯、發音或事實完全正確，亦非真人或專業顧問。重要資訊請自行核對；使用者如發現不當內容，可循本服務聯絡方式回報。

第 12 條　責任限制

1. 本服務係依其提供時之現況及可得性提供。

2. 於法律允許之最大範圍內，除法律另有強制規定外，如因可歸責於我們之事由致您受有損害，我們對您所負之損害賠償責任，以您於損害發生前 12 個月內，就該爭議事項實際支付予我們或透過本服務支付之總金額為上限。

3. 前項限制不適用於下列情形： （一）因我們故意或重大過失所致之損害。 （二）依法律不得限制或免除之責任。 （三）涉及人身傷害、死亡或其他依法不得預先限制之賠償責任。

4. 對於任何間接損害、衍生損害、逸失利益、商譽損失、資料遺失、學習中斷、期待利益落空或其他特別損害，除法律另有強制規定外，我們不負賠償責任。

第 13 條　個人資料保護

1. 我們重視您的個人資料保護，並將依隱私權政策及適用法令蒐集、處理及利用您的個人資料。

2. 您瞭解並同意，於使用 Google 登入、Apple 登入或本服務相關功能時，我們可能蒐集、處理及利用下列資料： （一）帳號識別資訊，例如第三方登入提供之姓名、暱稱、電子郵件地址、唯一識別碼。 （二）裝置與技術資訊，例如裝置型號、作業系統、App 版本、語言、IP 位址、錯誤紀錄。 （三）使用與學習資料，例如登入時間、使用紀錄、語言偏好、對話歷程、學習筆記、互動行為。 （四）點數與交易狀態資訊，例如點數餘額、購買時間、平台狀態、付款驗證與退款結果。 （五）其他您主動提供之資訊。

3. 您的個人資料蒐集目的，可能包括但不限於： （一）身分驗證與帳號管理。 （二）提供學習內容與個人化功能。 （三）處理點數、付款、客服與爭議。 （四）維護服務安全、偵測濫用、防止詐欺。 （五）統計分析、品質改善、功能優化。 （六）依法律義務或主管機關要求辦理事項。

4. 您得依適用法令及隱私權政策，就您的個人資料行使查詢、閱覽、製給複製本、補充、更正、停止蒐集、停止處理、停止利用及刪除等權利；但如依法得拒絕、暫緩，或因帳號管理、交易驗證、法令保存義務及資安需求而無法立即刪除者，不在此限。

5. 如您申請刪除帳號或刪除個人資料，我們將依隱私權政策、法令義務、備份機制、爭議保存及防詐需求處理。

6. 個人資料之詳細蒐集項目、目的、利用方式、期間、地區、對象及當事人權利，應以本服務另行公告之隱私權政策為準。

第 14 條　通知與聯繫

1. 我們得以 App 內公告、網站公告、推播通知、系統訊息、第三方平台通知頁面或您帳號對應之聯絡方式，作為與您聯繫、通知或送達之方式。

2. 您同意前項通知於發送、公告或顯示時，即視為已合法送達。

3. 如您因第三方帳號設定、裝置限制、通知權限關閉、網路異常或其他可歸責於您之事由，未能即時接收通知，不影響該通知之效力。

第 15 條　停權、限制使用與終止

1. 如有下列情形之一，我們得不經事前通知，逕行限制部分功能、暫停提供服務、終止契約關係或刪除相關資料： （一）違反本條款或其他公告規範。 （二）冒用他人身分、未經授權使用第三方登入帳號。 （三）從事詐欺、濫用、爬蟲、自動化抓取、破解、散布惡意程式或其他危害行為。 （四）侵害本公司、其他使用者或第三人之權利。 （五）長期未使用帳號，且我們已公告合理管理機制。 （六）因法令、法院、主管機關命令或第三方平台要求須為處置。 （七）其他我們合理認為有必要採取措施之情形。

2. 如因可歸責於您之事由致帳號遭停權、終止或限制使用，已支付費用及未使用點數依適用法律、商店退款規則與個案情況處理。

3. 帳號刪除、停權、終止或服務終止後，您就本服務之存取權、授權與使用權亦一併終止；但依法應保存之資料、已匿名化資料、統計資料、稽核資料及為爭議處理所必要之資料，仍得依法律或合理期間保存。

第 16 條　帳號刪除與點數

1. 您得依本服務 App 設定或網站帳號刪除頁所提供之流程申請刪除如言帳號資料。

2. 刪除如言帳號會使您無法再使用該帳號的對話、學習紀錄與未使用點數；必要的交易、退款、安全及稽核資料，依隱私權政策與法律處理。

3. 帳號刪除不自動產生退款。共用登入身分與其他 WayneMVRS App 的資料，不因您僅刪除如言帳號資料而一併刪除。

第 17 條　條款修訂

1. 我們得因法令變更、服務調整、技術更新、營運需求或其他合理原因，修訂本條款之全部或一部。

2. 條款修訂後，將以 App 內公告、網站公告或其他適當方式公布更新版本及生效日期。

3. 如屬重大變更，且可能影響您的重要權益，我們將於合理期間前通知您。

4. 於修訂條款生效後，您如繼續使用本服務，即視為您已同意修訂後之內容；如您不同意修訂內容，應停止使用本服務，並得依流程申請刪除如言帳號資料。

第 18 條　準據法與管轄法院

1. 本條款之成立、解釋、履行及相關爭議，均以中華民國（台灣）法律為準據法。

2. 因本條款或本服務所生之一切爭議，如有訴訟必要，除法律另有強制規定外，以臺灣臺北地方法院為第一審管轄法院。

第 19 條　條款可分割性與其他

1. 本條款任一條文如經認定為全部或一部無效、不合法或不可執行，不影響其他條文之效力。

2. 本條款未盡事宜，依適用法令、誠信原則、交易習慣及本服務相關政策處理。

3. 本條款之標題僅為閱讀方便，不影響各條文之解釋。
